In 2020 and 2021 the German Foreign Trade Regulation (Außenwirtschaftsverordnung), the Regulation governing Foreign Direct Investment (FDI) screening, has been tightened several times. Accordingly, FDI screening plays an important role and needs to be considered in most cross-border M&A transactions. This is in particular the case for transactions involving investors from China as some of the fairly recent changes in the Foreign Trade Regulations were directly targeted at investors from China.
